A man charged with strangulation, two others with burglary, and one on drug charges were among those sentenced in Marion Circuit Court Division 1 on May 18.
Joseph Brandon Hardin was sentenced to 5 years probated for 5 years with a 60-day alternative sentence to be served on weekends on the charge of second-degree strangulation and third-degree burglary and 12 months probated for 24 months on the charge of second-degree unlawful imprisonment. All counts run concurrently for 5 years, probated for 5 years. He must also have no contact with Brooke Sweeney, domestic violence and anger management counseling to be reviewed on Aug. 24 at 9:00 a.m., report to Probation and Parole and follow their recommendations, have no violations of the law, no use of drugs or alcohol, and no use/possession of firearms — review time for 60 days to be heard on June 1 at 9:00 a.m.
- Anthony C. Brown entered a plea of guilty to the charge of attempted tampering with physical evidence, for which he received 12 months, probated for 24 months, drug paraphernalia-buy/possess (12 months probated for 24 months), and possession of marijuana (30 days probated for 6 months). He must report to Probation and Parole and follow their recommendations, have no violations of the law, no use of drugs or alcohol, and no use/possession of firearms. He was sentenced on May 18, and Judge Todd Spalding signed the orders. The charge of first-degree possession of a controlled substance, first offense (methamphetamine), was dismissed. All counts will run concurrently.
- Jacob Tony Brown entered a plea of guilty. He was sentenced on May 18 on the charge of third-degree burglary (2 years pretrial diverted for 3 years) and theft by unlawful taking or disposition of all others (90 days probated for 6 months). All counts will run concurrent, must report to Probation and Parole and follow their recommendations, have no violations of the law, no use of drugs or alcohol, and no use/possession of firearms. He must pay restitution of $258.30 and be assessed by SSC, and follow all recommendations.
- James T. Newton entered a plea of guilty. He was sentenced on May 18 on the charge of second-degree criminal facilitation to burglary (12 months probated for 24 months) and criminal facilitation to theft by unlawful taking (90 days probated 6 months). He must report to Probation and Parole and follow their recommendations, have no violations of the law, no use of drugs or alcohol, no use/possession of firearms, and give truthful testimony against a co-defendant.
- Joseph Darrell Raley was sentenced to 1 year probated 2 years for first-degree possession of a controlled substance, first offense (methamphetamine), 1 year probated 2 years for the cultivation of marijuana, 5 or more plants, first offense, 12 months probated 24 months for trafficking in marijuana, less than 8 ounces, first offense, and 12 months probated 24 months for drug paraphernalia-buy/possess. He was sentenced on May 18 and must report to Probation and Parole and follow their recommendations to have no violations of the law, no use of drugs or alcohol, and no use/possession of firearms.
- Joseph Brandon Hardin was sentenced to 12 months and probated for 24 months on the charge of third-degree criminal abuse. He must have no contact with R.M., report to Probation and Parole, follow their recommendations, have no law violations, no use of drugs or alcohol, and no use/possession of firearms.
- William Connor Cornish pleaded not guilty and waived formal arraignment on the charges of second-degree burglary, tampering with a witness, and theft by unlawful taking or disposition of all others. He has a pretrial conference set for July 20 at 9:00 a.m. and a jury trial scheduled for Sept. 25 at 8:30 a.m.
- Daryl E. Tungate has his probation revoked and 1-year sentence imposed.
- Charles R. Whitlock had his probation revoked and 1-year sentence imposed. He also has a pretrial conference set for June 1 at 9:00 a.m. and a jury trial scheduled for June 26 at 8:30 a.m. on the charges of first-degree possession of a controlled substance, second offense (methamphetamine), drug paraphernalia-buy/possess, and possession of marijuana.
- Kasey Ratliff violated her bond terms by appearing in court heavily under the influence of meth and was remanded to custody without bond. She has a pretrial conference set for June 1 at 9:00 a.m. and a jury trial scheduled for July 24 at 8:30 a.m. on the charge of first-degree possession of a controlled substance, first offense (methamphetamine).
- Amanda B. Medley violated her terms of probation by being terminated from long-term treatment, and the court will impose one final sanction. Instead of revocation, Medley must complete long-term treatment and remain in custody until a treatment bed becomes available.
- In the case of April N. Dial, the court conducted a probation revocation hearing and concluded a sanction was appropriate in place of revocation, and a 90-day sanction was imposed. Dial can be released from custody on June 19 and shall report to probation twice monthly.
- In the case of Johnny C. Cox, the court conducted a probation revocation hearing, and the court concluded that he violated the terms of his probation and imposed a 60-day sanction probation is set for review on Aug. 24 at 9:00 a.m., and Cox can be released from custody on June 17.
- Thomas E. Stanley does not qualify for a public defender as he is employed, and his family posted a bond of $5,000. His arraignment was passed to June 15 at 9:00 a.m. He is facing two counts of first-degree strangulation, first-degree wanton endangerment, two counts of fourth-degree assault, domestic violence (minor injury), third-degree terroristic threatening, and first-degree persistent felony offender.
In Marion Circuit Court Division 2
- Donald R. Bell entered a guilty plea to facilitating burglary and was sentenced to 12 months probated for 24 months.
- Jordan T. Detwiler was sentenced to 3 years probated 3 years on the charge of theft by unlawful taking or disposition-auto-$1,000 but under $10,000, and 45 days probated six months for operating on a suspended/revoked operator’s license.
- Donald W. Mull pleaded guilty to multiple charges, including first-degree possession of a controlled substance, first offense-less than 2 grams methamphetamine, (3 years); tampering with physical evidence (1 year), first-degree fleeing or evading police-motor vehicle (5 years), drug paraphernalia-buy/possess (12 months), second-degree wanton endangerment (12 months), and operating on a suspended/revoked operator’s license (90 days).
- Ethan Troy Murphy pleaded guilty and was sentenced to 2 years pretrial diversion 3 years on five counts of first-degree wanton endangerment and tampering with physical evidence.
- Bailey G. Thompson pleaded guilty to first-degree possession of a controlled substance, first offense-cocaine (1 year pretrial diversion 2 years), second-degree possession of a controlled substance-hallucinogen (12 months probated 24 months), and drug paraphernalia-buy/possess (12 months probated 24 months).
- Joseph Michael Williams pleaded guilty to first-degree possession of a controlled substance, first offense-methamphetamine (2 years pretrial diversion 3 years), and 12 months probated 24 months for drug paraphernalia-buy/possess, fourth-degree assault domestic violence-no visible injury, and resisting arrest.
- Madonna Lynn Shelton pleaded guilty to first-degree facilitating trafficking in a controlled substance, first offense-greater or equal to 2 grams methamphetamine (2 years probated 3 years), and drug paraphernalia-buy/possess (12 months probated 24 months).
- Nathan L. Roller entered a plea of not guilty and waived formal arraignment on the charge of first-degree sexual abuse, victim under 12 years of age. The court has requested a competency hearing from KCP. He has a pretrial conference set for July 20 at 1:00 p.m. He remains jailed in the Marion County Detention Center on a $10,000 bond.
- Jerry T. Seabrooks entered a not guilty plea and waived formal arraignment to the charge of first-degree trafficking in a controlled substance, second or greater offense (greater or equal to 2 grams methamphetamine), drug paraphernalia-buy/possess, and first-degree persistent felony offender. He has a pretrial conference set for Aug. 10 at 1:00 p.m. and a jury trial scheduled for Oct. 17 at 8:30 a.m.
- Holly Shepperson pleaded not guilty and waived formal arraignment on the charges of first-degree possession of a controlled substance, third or greater offense (drug unspecified), two counts of third-degree assault-police/probation officer, drug paraphernalia-buy/possess, and resisting arrest. She has a pretrial conference set for July 20 at 1:00 p.m. and a jury trial scheduled for Sept. 12 at 8:30 a.m.
- Hunter L. Caldwell Livers entered a not guilty plea and waived formal arraignment on the charge of receiving stolen property $1,000 but under $10,000. He has a pretrial conference set for July 20 at 1:00 p.m. and a jury trial scheduled for Sept. 12 at 8:30 a.m.
